Terms of Service
Upon entering into Commission Agreement, the below TOS will apply.
Producer has the right to decline a Commission. Producer has the right to cancel and refund the money for a Commission at any time.
Producer reserves all rights to the work produced during a Commission, including WIP and Final Product.
Producer reserves the right to publish Commissioned Product as part of a portfolio and/or commercial body of work, publish or display Product for commercial purposes, advertisement purposes, or other purposes as needed.
Purchasing a Commission grants Personal Use of the Product. Purchaser may use the copyrighted artwork for Personal Use only.
If Purchaser breaks copyright infringement in any way, all rights and Personal Use of the Product is retracted.
The following is considered Copyright Infringement:
Reproducing or using Product commercially, or in any way to gain a profit from Product.
Taking credit for the creation of the Product.
Removing any watermarks or signatures from Product.
altering the Product without Producer's consent.
Purchases of Commercial Rights to any Product are not offered at this time.
Credit is still required for usage of the artwork, even with Personal Use.
Commissions will be paid in full, up-front, before work will begin.
Payment may be made via Paypal, or Stripe invoice. Payment is expected within 3 business days. Failure to pay during the allotted time will result in commission slot cancellation.
No refunds will be issued after Final Product is delivered. Any changes, full, or partial refunds must be requested before delivery of Final Product.
Failure to deliver a Final Product within a suitable amount of time, as agreed upon by both parties before invoicing, will result in a full refund.
Work In Progress will be delivered in stages as agreed upon by both parties. Typically, WIP will be delivered between sketch, ink, and color phases.
The WIP delivery is to be discussed before payment, to allow for suitable time for change, full, or partial refund requests.
The more WIP required, the longer time will be required to complete a Final Product.
Large or complex changes, rushes on timetable, or requests for changes after delivery of Final Product will incur extra charges.
Commissions may be cancelled or declined at any time before an Invoice is Paid. Commissioners have no rights to cancellation or refunds after an Invoice is Paid.
Commissioners have no rights to usage of Product, Personal or otherwise, if chargebacks are filed, or Payment is in any way refunded, cancelled, or otherwise unpaid to the Producer.
Producer reserves the right to resell Product if Personal Use is retracted due to nonpayment, Copyright Infringement, or other circumstances.
Above TOS are liable to changes made by discussing with the Producer prior to Payment.
